Handling haram items in workplace


A person has a job as a worker in a big warehouse. His job is to move the items in the warehouse. Is it permissible to move haram items like cans of non-halal meat, alcohol and swine meat etc? 


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

As Muslims, we are averse to anything that Almighty Allah has declared as Haraam and unlawful. This is particularly true with regards to alcohol and swine. Every Muslim abhors coming into contact with either of the two.

If it is possible for the person to avoid moving the Haraam items, then he should avoid it. He may request his employer to excuse him from moving those items. If that is not possible and he is compelled to work there, then he will be excused in doing so.[1] In this case, he should make tawbah and istighfaar.

 قَالَ: (وَمِنْ حَمَلَ خَمْرًا لِذِمِّيٍّ طَابَ لَهُ الْأَجْرُ) وَقَالَا: يُكْرَهُ لِأَنَّهُ أَعَانَهُ عَلَى الْمَعْصِيَةِ. وَفِي الْحَدِيثِ: «لَعَنَ اللَّهُ فِي الْخَمْرِ عَشْرًا " وَعَدَّ مِنْهُمْ " حَامِلَهَا» وَلَهُ أَنَّ الْمَعْصِيَةَ شُرْبُهَا، وَلَيْسَ مِنْ ضَرُورَاتِ الْحَمْلِ وَهُوَ فِعْلُ فَاعِلٍ مُخْتَارٍ، وَمَحْمَلُ الْحَدِيثِ الْحَمْلُ لِقَصْدِ الْمَعْصِيَةِ حَتَّى لَوْ حَمَلَهَا يُرِيقُهَا أَوْ لِيُخَلِّلُهَا جَازَ، وَعَلَى هَذَا الْخِلَافِ إِذَا آجَرَ بَيْتًا لِيَتَّخِذَهُ بَيْتَ نَارٍ أَوْ بَيْعَةً أَوْ كَنِيسَةً فِي السَّوَادِ. لَهُمَا أَنَّهُ أَعَانَهُ عَلَى الْمَعْصِيَةِ، وَلَهُ أَنَّ الْعَقْدَ وَرَدَ عَلَى مَنْفَعَةِ الْبَيْتِ حَتَّى وَجَبَتِ الْأُجْرَةُ بِالتَّسْلِيمِ وَلَيْسَ بِمَعْصِيَةٍ، وَالْمَعْصِيَةُ فِعْلُ الْمُسْتَأْجِرِ وَهُوَ مُخْتَارٌ فِي ذَلِكَ


درر الحكام شرح غرر الأحكام (1/ 320)

(قَوْلُهُ: وَجَازَ حَمْلُ خَمْرِ ذِمِّيٍّ بِأَجْرٍ) أَيْ فَيَطِيبُ لَهُ الْأَجْرُ عِنْدَ أَبِي حَنِيفَةَ خِلَافًا لَهُمَا لِأَنَّهُ - عَلَيْهِ السَّلَامُ - «لَعَنَ فِي الْخَمْرِ عَشَرَةً مِنْهَا حَامِلُهَا» وَلِأَبِي حَنِيفَةَ أَنَّ الْحَمْلَ لَيْسَ بِمَعْصِيَةٍ وَالْحَدِيثُ مَحْمُولٌ عَلَى الْحَمْلِ الْمَقْرُونِ بِقَصْدِ الْمَعْصِيَةِ وَعَلَى هَذَا الْخِلَافِ إذَا آجَرَ دَابَّتَهُ لِنَقْلِ الْخَمْرِ أَوْ نَفْسَهُ لِرَعْيِ الْخِنْزِيرِ يَطِيبُ لَهُ الْأَجْرُ عِنْدَهُ وَعِنْدَهُمَا يُكْرَهُ كَمَا فِي التَّبْيِينِ

[حَمْلُ خَمْرِ الذِّمِّيِّ بِأَجْرٍ]

قَالَ: - رَحِمَهُ اللَّهُ تَعَالَى - (وَحَمْلُ خَمْرِ الذِّمِّيِّ بِأَجْرٍ) يَعْنِي جَازَ ذَلِكَ وَهَذَا عِنْدَ الْإِمَامِ وَقَالَا يُكْرَهُ لِأَنَّهُ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - «لَعَنَ فِي الْخَمْرِ عَشَرَةً وَعَدَّ مِنْهَا حَامِلَهَا» وَلَهُ أَنَّ الْإِجَارَةَ عَلَى الْحَمْلِ وَهُوَ لَيْسَ بِمَعْصِيَةٍ وَإِنَّمَا الْمَعْصِيَةُ بِفِعْلِ فَاعِلٍ مُخْتَارٍ فَصَارَ كَمَنْ اسْتَأْجَرَهُ لِعَصْرِ خَمْرِ الْعِنَبِ وَقَطْفِهِ، وَالْحَدِيثُ يُحْمَلُ عَلَى الْحَمْلِ الْمَقْرُونِ بِقَصْدِ الْمَعْصِيَةِ وَعَلَى هَذَا الْخِلَافِ إذَا أَجَّرَ دَابَّةً لِيَحْمِلَ عَلَيْهَا الْخَمْرَ أَوْ نَفْسَهُ لِيَرْعَى لَهُ الْخَنَازِيرَ فَإِنَّهُ يَطِيبُ لَهُ الْأَجْرُ عِنْدَهُ وَعِنْدَهُمَا يُكْرَهُ وَفِي التَّتَارْخَانِيَّة: وَلَوْ أَجَّرَ الْمُسْلِمُ نَفْسَهُ لِذِمِّيٍّ لِيَعْمَلَ فِي الْكَنِيسَةِ فَلَا بَأْسَ بِهِ وَفِي الذَّخِيرَةِ إذَا دَخَلَ يَهُودِيٌّ الْحَمَّامَ هَلْ يُبَاحُ لِلْخَادِمِ الْمُسْلِمِ أَنْ يَخْدُمَهُ قَالَ: إنْ خَدَمَهُ طَمَعًا فِي فُلُوسِهِ فَلَا بَأْسَ بِهِ وَإِنْ خَدَمَهُ تَعْظِيمًا لَهُ يُنْظَرُ إنْ فَعَلَ ذَلِكَ لِيُمِيلَ قَلْبَهُ إلَى الْإِسْلَامِ فَلَا بَأْسَ بِهِ وَإِنْ فَعَلَهُ تَعْظِيمًا لَهُ كُرِهَ ذَلِكَ وَعَلَى هَذَا إذَا دَخَلَ ذِمِّيٌّ عَلَى مُسْلِمٍ فَقَامَ لَهُ طَمَعًا فِي إسْلَامِهِ فَلَا بَأْسَ بِهِ وَإِنْ قَامَ لَهُ تَعْظِيمًا لَهُ كُرِهَ لَهُ ذَلِكَ
